Terms of service
1. General Provisions
1.1. These goods purchase and sale rules (hereinafter referred to as "Rules") are a legal document binding on the Parties, which establishes the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods from the online store.
1.2. The Seller reserves the right to change, amend, or supplement the rules at any time, considering the requirements set by legal acts. The Buyer is notified on the website of the online store. The rules applicable at the time the Buyer submits the order apply to the Buyer when shopping in the online store.
1.3. Only the following individuals have the right to purchase from the online store:
1.3.1. Capable individuals, i.e., those who have reached adulthood and whose legal capacity is not restricted by court order;
1.3.2. Legal entities;
1.3.3. Authorized representatives of the persons mentioned above.
1.4. By confirming the rules, the Seller also guarantees that, based on clause 1.3 of the rules, the Buyer has the right to purchase goods from the online store.
1.5. The contract between the Buyer and the Seller is considered concluded at the moment when the Buyer, having created a shopping cart in the online store, specified the delivery address, selected a payment method, and reviewed the Seller's rules, clicks the "Confirm Order" button (see point 5 "Ordering Goods, Prices, Payment Procedure, Terms").
1.6. Each contract concluded between the Buyer and the Seller is stored in the online store.
2. Personal Data Protection
2.1. The Buyer can order goods from the online store:
2.1.1. by registering on this online store – entering the data requested during registration;
2.1.2. without registering on this online store.
2.2. When ordering goods in the ways specified in section 2.1 of the rules, the Buyer must provide the necessary personal data for the proper execution of the order in the relevant fields provided by the Seller: name, surname, delivery address, phone number, and email address.
2.3. By confirming these rules, the Buyer agrees that the personal data provided in point 2.2 will be processed for the purposes of selling goods and services in the online store, business analysis, and direct marketing.
2.4. By agreeing that the Buyer's personal data will be processed for the purpose of selling goods and services in the Seller's online store, the Buyer also agrees to receive informational messages necessary for the order's execution at the Buyer's provided email address and phone number.
2.5. The Buyer, by registering on the online store and ordering goods, undertakes to keep and not disclose login details to anyone.
3. Buyer's Rights and Obligations
3.1. The Buyer has the right to purchase goods from the online store in accordance with these Rules and other sections of information provided by this online store.
3.2. The Buyer undertakes to accept the ordered goods and pay the agreed price for them.
3.3. If the data provided by the Buyer in the registration form changes, the Buyer must update them immediately.
3.4. The Buyer undertakes not to share login details with third parties. If the Buyer loses login details, they must immediately inform the Seller using the contact details provided in the "Contact" section.
3.5. By using the online store, the Buyer agrees to these purchase-sale rules and undertakes to comply with them and not violate Lithuanian legal acts.
4. Seller's Rights and Obligations
4.1. The Seller undertakes to provide the Buyer with all the necessary conditions for using the online store’s services properly.
4.2. If the Buyer attempts to harm the stability and security of the Seller's online store or violates their obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer’s ability to use the online store or, in exceptional cases, cancel the Buyer’s registration.
4.3. The Seller undertakes to respect the Buyer’s privacy regarding the personal information provided in the online store’s registration form.
4.4. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer.
5. Ordering Goods, Prices, Payment Procedure, and Terms
5.1. The Buyer can purchase goods from the online store 24/7, 7 days a week.
5.2. The contract becomes valid when the Buyer clicks the "Confirm Order" button, and upon receiving the order, the Seller confirms it by sending a confirmation email to the Buyer’s provided email address.
5.3. The prices of goods in the online store and the order are indicated in euros, including VAT.
5.4. The Buyer pays for the goods using one of the following methods:
5.4.1. Payment via e-banking – prepayment using the Buyer’s e-banking system. To use this payment method, the Buyer must have an e-banking agreement with one of the following banks: SEB Bank, Swedbank, Citadelė Bank, Šiaulių Bank.
5.4.2. Payment via bank transfer – prepayment when the Buyer prints the order and visits the nearest bank branch to transfer funds to the online store's bank account.
5.5. The Buyer undertakes to pay for the goods immediately. Only after receiving the payment will the goods be prepared for shipment, and the delivery term will start counting.
5.6. Payments are possible in euros.
5.7. Payments are processed using the Klix payment platform.
6. Goods Delivery
6.1. Goods are delivered to the Buyer within the European Union within 2-5 business days and outside the EU within 3-7 business days from the receipt of payment.
6.2. The Buyer, selecting the delivery service during the order process, undertakes to specify the exact delivery location for the goods.
6.3. The Buyer undertakes to receive the goods personally. If the Buyer cannot accept the goods personally, and they are delivered to the specified address, the Buyer cannot make claims to the Seller about delivery to the wrong party.
6.4. The goods are delivered by the Seller’s authorized representative (courier).
6.5. The Seller’s authorized courier delivers the goods to the Buyer according to the terms specified in the product descriptions. These terms are preliminary and do not apply if the required goods are not available in the Seller's warehouse, and the Buyer is notified about the shortage of the ordered goods. The Buyer agrees that, in exceptional cases, the delivery may be delayed due to unforeseen circumstances beyond the Seller’s control. In such a case, the Seller undertakes to contact the Buyer immediately and agree on the terms of delivery.
6.6. In all cases, the Seller is not responsible for delivery delays if the goods are not delivered or delivered late due to the Buyer’s fault or circumstances beyond the Seller’s control.
6.7. The Buyer must immediately inform the Seller if the shipment is delivered in a damaged or otherwise compromised package, or if incorrect or incomplete goods are delivered.
6.8. The Buyer must indicate any damage to the package on the delivery document presented by the courier, or prepare a separate act describing the damage. This must be done in the presence of the courier. If these actions are not taken, the Seller is not liable for damage to the goods that the Buyer did not mark on the courier’s delivery document.
7. Product Quality and Warranty
7.1. The data for each product sold in the online store is generally provided in the product description.
7.2. The Seller is not responsible if the products in the online store differ in color, form, or other parameters from the actual size, shape, or color of the products due to the Buyer’s monitor settings.
7.3. If the Seller does not provide a quality warranty for certain products, the warranty provided by the relevant legal acts applies.
8. Product Returns and Exchanges
8.1. When returning goods, the Buyer must comply with the following conditions:
8.1.1. The returned product must be in its original packaging.
8.1.2. The returned product must be in the same condition as it was received by the Buyer.
8.1.3. The returned product must be clean.
8.1.4. The returned product must not have expired.
8.1.5. A written request must be submitted, indicating the Buyer’s wish to return the paid amount or exchange the product for a quality product.
8.1.6. A document confirming the purchase (receipt, invoice, delivery confirmation) must be provided.
8.2. The Seller has the right not to accept returned goods if the Buyer does not comply with the return procedure specified in clause 8.1.
8.3. When returning an incorrect or defective product, the Seller undertakes to accept the goods and replace them with suitable goods.
8.4. If the Seller does not have suitable goods for replacement, the Buyer will receive a refund excluding delivery charges.
9. Buyer and Seller Liability
9.1. The Buyer is fully responsible for the accuracy of the personal data provided. If the Buyer does not provide accurate personal data in the registration form, the Seller is not liable for the consequences and has the right to claim compensation for any direct losses incurred.
9.2. The Buyer is responsible for actions taken while using the online store.
9.3. The registered Buyer is responsible for the transmission of their login details to third parties. If a third party uses the online store by logging in with the Buyer’s details, the Seller will treat that person as the Buyer.
9.4. The Seller is relieved of any liability if the Buyer fails to review these rules despite the opportunity to do so, or does not follow the Seller’s recommendations.
9.5. If the Seller’s online store contains links to other companies, institutions, organizations, or personal websites, the Seller is not responsible for the content or activities on those sites, does not monitor them, and does not represent those companies or individuals.
9.6. In case of damage, the responsible party must compensate the other party for direct losses.
10. Marketing and Information
10.1. The Seller may initiate various promotions in the online store at their discretion.
10.2. The Seller has the right to change the terms of promotions unilaterally, without separate notice, or cancel them. Any changes to or cancellation of promotion terms will only apply to the future, from the moment the change or cancellation is made.
10.3. The Seller sends all notifications using the contact details provided in the Buyer’s registration form.
10.4. The Buyer sends all inquiries and notifications to the Seller using the contact details provided in the "Contact" section of the online store.
10.5. The Seller is not responsible if the Buyer does not receive informational or confirmation messages due to issues with the internet connection or the email service provider’s network.
11. Final Provisions
11.1. These goods purchase and sale rules are made in accordance with the laws and legal acts of the Republic of Lithuania.
11.2. Any disputes arising from the implementation of these rules are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the laws of the Republic of Lithuania.
